Our Programs Terms and Conditions.

These terms and conditions pertain to an individual and/or company's participation in the Artmill affiliate program.

We will pay you a 10% commission! 

By joining the Artmill Affiliate Program, you will earn a 10% commission on all sales including Postage and Packing charges generated through your site. That is, we pay you a commission for every customer click-through from your WebPages to Artmill that results in a successful purchase. Even if your customer doesn't purchase services right away you still get paid. If your visitor returns to Artmill within 5 years we will still pay you the full 10% commission. That visitor doesn't even have to return through your site.

Your commission is paid monthly on the 10th each month. There is no cheque-cutting fee to be paid by affiliates.

1. Joining the Program

Your participation in the program is solely for this purpose: to legally advertise the Artmill site and services and receive a commission based on services and/or products purchased by your referral individuals/co`s.

2. Revocation of Affiliate Status

Your affiliate application and status in the program may be suspended or terminated for any of the following reasons: 

Inappropriate advertisements (False claims, misleading hyperlinks) Spamming (mass email, mass newsgroup posting, etc...)  Advertising on sites containing/promoting illegal activities Violation of intellectual property rights (copying Artmill material). You will be informed of the reason of revocation. See also 7.

3. Linking to Artmill

You may use graphic and/or text links on your website. You may use your Artmill referral address in classifieds and FFA web sites. The site may also be advertised "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by Artmill only. You are not allowed to use your Artmill links in any outgoing email unless it was specifically asked for/or authorised by Artmill.

Any affiliate sending Spam will be immediately removed from the affiliate system, lose all commissions due and possibly be faced with legal action.

5. Terms of the agreement

These terms will begin upon your signup with the affiliate program and will end when either you or Artmill terminates your affiliate status. The terms of this agreement may be modified at any time by Artmill. If any modification is unacceptable to you, your only choice is to terminate your affiliate status. Your continuing participation in the program will constitute your acceptance of any change. You will be informed of all changes 21 days in advance.

6. Liability

Artmill will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program. Artmill does not make any expressed or implied warranties with respect to the affiliate program and/or services/products sold at this site. We make no claim that the operation of Artmill will be error-free and will not be liable for any interruptions or errors. 

7. Predatory Advertising 

Affiliate agrees not to use any predatory advertising methods in the promotion of Artmill services or affiliate program. 

Predatory advertising is defined as any method that creates or overlays links or banners on web sites, spawns browser windows, or any method invented to generate traffic from a web site without that web site owner's expressed, written permission. Examples include, but are not limited to, keyword parsing browser plugins, banner replacement technology, and browser spawning technology that is not web site dependent. 

Participation in predatory advertising programs will be cause for affiliates immediate termination. 

8. Affiliate's Rights and Protection  

• We do not require that you post a link that is not a direct part of the commissionable relationship.
• We do not require a membership fee.
• We publish a Privacy Statement.
• We publish an Affiliate Agreement.

We promise to contact affiliates via email regarding any substantive changes to the terms of their affiliate agreement -- including changes to commission rate, payment frequency, the rights and protections of affiliates or other major contractual issues -- as well as posting those details on our website. 

We operate within the legal requirements of our jurisditcion.

9. Limitation of Liability: 

We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement. 

10. Independent Investigation: 

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT. 

11. Miscellaneous: 

This Agreement shall be governed by and construed in accordance with English Law and each Party agrees to submit to the exclusive jurisdiction of the English Courts as regards any claim or matter arising under this Agreement. This Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
